Advancing Alternatives Product Warranty

 

The following warranties (“Warranty”) apply to sales by Advancing Alternatives (“AA”) and are hereby incorporated into, and made part of, all proposal and purchase agreements unless otherwise agreed by AA and the Purchaser (the “Purchaser”):

All warranties begin on the date of invoice, some products may carry a longer warranty term as specified below. Except as provided in this Warranty Section, we make NO representation or Warranty of any kind…either express or implied, with respect to any product, including, without limitation, a warranty of merchantability, non-infringement or fitness for any particular purpose, and we hereby disclaim the same.

We will not honor warranties on items that have been subject to abnormal use, which are and are not limited to: abnormal conditions, improper storage, exposure to moisture or dampness, unauthorized modifications, unauthorized repair, misuse, neglect, accident, alteration, or other acts which are not our workmanship or construction, including damage caused in shipping.

Warranties do not apply to products that have been improperly installed. Refer to Installation Guides or Instruction Sheets for our recommendations for proper installation. If you did not receive any instructions, please contact your sales/service representative. Also, our warranty does not apply to any product that has been damaged by external causes such as fire, flood, sand, dirt, lightning, exposure to elements, acts of God, battery leakage, theft, blown fuses, improper use of an electrical source or connection to product not recommended in writing for interconnection by us.

To minimize any risk of potential safety problems, you should follow all applicable local and national codes that regulate the installation and operation of your equipment. These codes vary from area to area and usually change with time. It is your responsibility to determine which codes should be followed and to verify that the equipment, installation and operation, is in compliance with the latest revision of these codes. We will not assume any responsibility for your product design, installation or operation.

AA warrants that the Products, under normal use, and with routine maintenance, will be free from defects in materials and workmanship for a period of one (1) year from the date of receipt of the Products. This Limited Warranty is subject to the requirements, exclusions and limitations stated below. This limited warranty only applies to the original purchaser and may not be transferred to any other party.

Only components and parts of the Products manufactured by AA are covered by this warranty. Parts not manufactured by AA are specifically excluded and AA makes no warranty regarding such parts (the “Excluded Parts”). AA hereby assigns to the Purchaser any warranties from the manufacturers of the Excluded Parts, if any.

AA does not warrant, in any way, that the greenhouse or structure will be suitable for any use, including growing crops, and is not liable for any crop loss or damage caused by heat, cold, lack of sufficient water, or any other reason. Purchaser is responsible for ensuring suitable growing conditions specific to Purchaser’s crop and climate, including the use of backup heating or ventilation as needed. The operational temperature inside the greenhouse must be maintained at a minimum of 68 degrees Fahrenheit or 20 degrees Celsius under loading conditions. Failure to maintain this minimum temperature will void all warranties.

This limited warranty shall be void if: (a) repairs or alterations are made to the Products or (b) if the Products are misused, abused, involved in an accident, or damaged, including by way of illustration and not limitation, failure to perform normal maintenance, or any other misuse or abuse of the Products, electrical surges, lightning strikes, fire or other acts of nature.

AA’s sole and exclusive obligation under this warranty shall be to remedy or replace any component of the Products, provided: (1) the defect has been promptly reported to AA (2) the reported defect is reasonably determined, upon investigation by AA, to arise from a defect in material or workmanship; and (3) the Products have not been altered, changed or used with parts and accessories which were not approved by AA. No reimbursement will be made for repairs made without the prior written consent of AA.

To process any claim under this limited warranty, Purchaser must contact AA (contact information is located on the Agreement). If the claim is approved, the Purchaser, at the Purchaser’s cost, must send the defective parts to AA. AA will repair or replace the defective part and send the new or repaired part back to the Purchaser. The Purchaser is responsible for uninstalling the defective part and reinstalling the new or repaired part. In no event will this limited warranty extend to defects of which AA is given notice more than the periods set forth above.

THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES NOT EXPRESSLY PROVIDED HEREIN WHICH BUT FOR THIS PROVISION MIGHT ARISE BY OPERATION OF LAW, INCLUDING ANY EXPRESS WARRANTIES MADE OUTSIDE THIS LIMITED WARRANTY, IMPLIED WARRANTIES OF MERCHANTABILITY, IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, AND ANY REMEDY FOR BREACH OF CONTRACT. THESE WARRANTIES ARE HEREBY EXPRESSLY EXCLUDED AND DISCLAIMED. IF THEY CANNOT BE DISCLAIMED, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY LIMITED TO A TERM OF ONE (1) YEAR, UNLESS ANY APPLICABLE STATE LAW PROVIDES OTHERWISE. UNDER NO CIRCUMSTANCES SHALL AA BE LIABLE TO PURCHASER, OR ANY OTHER PERSON FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER ARISING OUT OF BREACH OF WARRANTY, BREACH OF CONTRACT, TORT OR OTHERWISE. NO ONE, INCLUDING AUTHORIZED AA SALES REPRESENTATIVES, IS AUTHORIZED TO MAKE FURTHER OR ADDITIONAL WARRANTIES ON BEHALF OF AA. AUTHORIZED REPAIRS DO NOT EXTEND THE TERM OF THIS LIMITED WARRANTY.

30 day limited warranty
under normal use, conditions and proper installation

Accessories and Related Products, includes Adapters, Crank Handles, Drill Cranks, EZ Snap Rope Hooks, Guide Pipe, Pulleys and Rope.
Extrusions, Pipe and Tube, includes Flare Tube, Roll Lock, Roll Bar Cap, Roll Pipe, Wire Lock bases, and all steel tube products.

6 months limited warranty
under normal use, conditions and proper installation

Manual Gear Cranks,  includes individual gears (sold without guide wheelsets or stationary mounting brackets)
Winches and Lashing Winches, includes winch (1400, 1900, 2300, 2500 and 3200), LWO
Fabrics and Poly, includes vinyl, clear, frosty, blackout and poly. (Manufacturer may provide additional warranty, AA hereby assigns to the Purchaser any warranties from the manufacturers)

One year limited warranty
Under normal use, conditions (as rated) and proper installation

Electric Motors, includes 110-volt tube motors (no warranty provided on gearbox motors)
Manual Operators, GC5:1B, GC5:1, GC10:1, GC13:1, GC15:1, GC30:1(one and two direction output where applicable)

Two year limited warranty
Under normal use, conditions (as rated) and proper installation

Vent Control Units, includes the Aegis line of controllers, the VCU line, our interface boxes and our manual transformer control boxes. (Temperature, Humidity, Wind and Rain Sensors excluded)

Five year limited warranty
When powered by Advancing Alternatives controller, under normal use, conditions and properly installed.

Low Voltage Motors, LVM 60’s, 100’s, 180’s and 200’s (water markings in limit switches and upside-down installation voids warranty)
